Terms of Service
Effective Date: March 29, 2026
Please read these Terms of Service (“Terms”) carefully before accessing or using Triturio (“the Service”). These Terms govern your access to and use of the Triturio web application, question bank, and all related content provided by Triturio, LLC (“Triturio,” “we,” “us,” or “our”). By creating an account or accessing the Service, you agree to be bound by these Terms. If you do not agree, do not access or use the Service.
1. Eligibility
You must be at least 18 years of age to use the Service. By creating an account, you represent and warrant that you are 18 or older and that you have the legal capacity to enter into a binding agreement. The Service is intended for use by pharmacy students, pharmacists, and other individuals preparing for the Multistate Pharmacist Jurisprudence Examination (MPJE®) or the Uniform Multistate Pharmacist Jurisprudence Examination (UMPJE). Use of the Service for any other purpose is not permitted.
2. Account Registration and Security
To access the Service, you must register for an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@triturio.com if you become aware of any unauthorized access to or use of your account.
You may not register more than one account. Accounts are non-transferable and may not be sold, gifted, or assigned to another person.
3. Single-User License; Prohibition on Account Sharing
Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to access the Service for your own personal, non-commercial exam preparation purposes. Your account is for your individual use only. You may not share your login credentials with any other person or allow any other person to access the Service through your account.
If Triturio detects or reasonably suspects that an account is being accessed by more than one individual, Triturio reserves the right to immediately suspend or permanently terminate that account without notice and without any refund. Determination of account sharing is at Triturio's sole discretion.
4. Access Period
Upon payment, you will receive access to the Service for a period of three (3) calendar months from the date of purchase (“Access Period”). Your Access Period begins on the date your payment is confirmed, regardless of whether you actively use the Service.
At the end of your Access Period, your access to the Service will be suspended. You may renew your access by repurchasing the applicable exam subscription. Each repurchase adds an additional three (3) calendar months to the date of that repurchase. If you repurchase before your current Access Period expires, the new period begins immediately upon repurchase, not upon the expiration of the existing period.
Triturio does not guarantee that any specific content, features, or question bank items will remain available throughout your Access Period. We reserve the right to modify, update, or remove content at any time.
5. Payment and Refund Policy
5.1 Payment
All fees are stated in U.S. dollars and are due in full at the time of purchase. Payment is processed through our third-party payment processor. By submitting payment, you authorize the charge to your designated payment method. Triturio does not store your full payment card details.
5.2 No Refunds
ALL PURCHASES ARE FINAL AND NON-REFUNDABLE. Because access to the Service and its digital content is granted immediately upon purchase, Triturio does not offer refunds, credits, or exchanges under any circumstances, including but not limited to:
- You did not use the Service during your Access Period.
- You failed the MPJE® or UMPJE examination.
- You purchased the wrong state or exam type.
- Technical issues outside Triturio's reasonable control.
- You decided you no longer needed exam preparation.
By completing your purchase, you acknowledge and agree to this no-refund policy.
5.3 Taxes
You are responsible for any applicable taxes, duties, or other governmental assessments associated with your purchase, except for taxes based on Triturio's net income.
6. Acceptable Use
You agree not to, and will not assist any third party to:
- Copy, reproduce, distribute, publish, display, transmit, or create derivative works of any content from the Service without Triturio's prior written consent.
- Use the Service for any commercial purpose, including reselling, sublicensing, or providing exam preparation services to others.
- Screen-record, screenshot, scrape, crawl, or otherwise systematically extract content from the Service.
- Attempt to reverse-engineer, decompile, disassemble, or otherwise derive the source code or underlying structure of the Service.
- Use automated tools, bots, scripts, or other means to access the Service or extract content.
- Circumvent, disable, or interfere with security features of the Service.
- Harass, threaten, or harm other users or Triturio personnel.
- Upload or transmit viruses, malware, or any other harmful or malicious code.
- Violate any applicable local, state, national, or international law or regulation.
Triturio reserves the right to investigate suspected violations and to take appropriate action, including account suspension or termination, removal of content, and referral to law enforcement authorities.
7. Intellectual Property and Content Ownership
All content available through the Service — including but not limited to practice questions, answer choices, explanations, competency mappings, study materials, text, graphics, logos, and software — is owned by or licensed to Triturio and is protected by United States copyright, trademark, trade secret, and other intellectual property laws.
Nothing in these Terms grants you any ownership rights in the Service or its content. The limited license granted to you under Section 3 does not include the right to sublicense, sell, reproduce, or otherwise exploit any content from the Service. Any unauthorized use of Triturio's content may result in legal action.
MPJE® is a registered trademark of the National Association of Boards of Pharmacy (NABP®). Triturio is not affiliated with, sponsored by, or endorsed by NABP or any board of pharmacy.
8. No Guarantee of Examination Passage
TRITURIO MAKES NO REPRESENTATION, WARRANTY, OR GUARANTEE THAT USE OF THE SERVICE WILL RESULT IN PASSING THE MPJE®, UMPJE, OR ANY OTHER EXAMINATION, OR IN OBTAINING OR MAINTAINING ANY PROFESSIONAL LICENSE OR CERTIFICATION. Exam outcomes depend on many factors outside Triturio's control, including your individual preparation, the specific content of your examination, and applicable state laws at the time of your exam.
9. Not Legal Advice; Content Disclaimer
THE CONTENT PROVIDED THROUGH THE SERVICE IS FOR EXAM PREPARATION PURPOSES ONLY AND DOES NOT CONSTITUTE LEGAL ADVICE, LEGAL OPINION, OR PROFESSIONAL GUIDANCE OF ANY KIND. Nothing in the Service should be interpreted as legal counsel or as guidance for clinical, professional, or regulatory practice decisions.
Pharmacy law is complex, varies by jurisdiction, and changes frequently. Content in the Service reflects laws, regulations, and guidance as understood at the time of content creation. Triturio makes no representation that any specific content is complete, current, or accurate as of the date you access it. You should always consult qualified legal counsel or your state board of pharmacy for authoritative guidance on legal requirements applicable to your practice.
10. State-Specific Content and Currency
Triturio's content is organized by jurisdiction. State-specific content reflects the laws and regulations of the applicable state as understood at a particular point in time. Laws and regulations change frequently, and Triturio does not guarantee that state-specific content reflects the most current law. You acknowledge that discrepancies may exist between Triturio's content and current law, and that Triturio is not responsible for any consequences arising from reliance on content that may be outdated.
11. Data and Account Retention
Triturio collects and stores account data, usage data, and study progress data as described in our Privacy Policy. During your Access Period, your study progress, performance data, and account information are retained on our servers.
Following the expiration of your Access Period, Triturio may retain your account information and study data to facilitate potential renewal and to improve the Service. You may request deletion of your account and associated personal data at any time by contacting support@triturio.com. Certain data may be retained in anonymized or aggregated form for analytical purposes, even after account deletion.
Triturio implements reasonable technical and organizational measures to protect your data, but cannot guarantee absolute security. By using the Service, you acknowledge and accept these limitations.
12. Modifications to the Service and Content
Triturio reserves the right, at any time and without notice, to modify, update, suspend, or discontinue the Service or any portion thereof, including removing, correcting, or adding questions, explanations, or other content. Triturio shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
13. Account Termination
Triturio may suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice, including for violation of these Terms. Upon termination:
- Your right to access the Service immediately ceases.
- No refund will be issued for any remaining access period.
- Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimer of warranties, limitation of liability, and dispute resolution) shall survive.
You may terminate your account at any time by contacting support@triturio.com. Account termination does not entitle you to a refund.
14. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TRITURIO EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. TRITURIO DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT DEFECTS WILL BE CORRECTED.
15. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TRITURIO, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, SERVICE INTERRUPTION, COMPUTER DAMAGE, OR THE COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF TRITURIO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN ANY EVENT, TRITURIO'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO TRITURIO IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, Triturio's liability shall be limited to the maximum extent permitted by applicable law.
16. Indemnification
You agree to indemnify, defend, and hold harmless Triturio and its officers, directors, employees, agents, licensors, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any content you submit or transmit through the Service.
17. Dispute Resolution
17.1 Informal Resolution
Before initiating any formal dispute resolution proceeding, you agree to contact Triturio at support@triturio.com and attempt in good faith to resolve any dispute informally. Triturio will attempt to respond within thirty (30) days. Either party may proceed to formal resolution if the dispute is not resolved within sixty (60) days of first notification.
17.2 Binding Arbitration
Except for disputes subject to small claims court jurisdiction, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved exclusively by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect. The arbitration shall be conducted in English and, unless otherwise agreed, shall take place in Atlanta, Georgia.
The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court having jurisdiction. Each party shall bear its own costs and attorneys' fees unless the arbitrator determines that an award of fees is appropriate.
17.3 Class Action Waiver
YOU AND TRITURIO EACH AGREE THAT ANY DISPUTE RESOLUTION PROCEEDING WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If for any reason a claim proceeds in court rather than arbitration, both you and Triturio waive any right to a jury trial.
18. Governing Law
These Terms and any dispute arising hereunder shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions. Subject to the arbitration provision above, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Fulton County, Georgia, for any disputes not subject to arbitration.
19. Force Majeure
Triturio shall not be liable for any failure or delay in performance of its obligations under these Terms due to causes beyond its reasonable control, including but not limited to acts of God, natural disasters, epidemics, pandemics, internet or infrastructure outages, actions of third-party service providers, cyberattacks, or government orders.
20. Changes to These Terms
Triturio reserves the right to modify these Terms at any time. When we make material changes, we will update the Effective Date at the top of this page and, where feasible, provide notice through the Service or via the email address associated with your account. Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
21. Miscellaneous
21.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Triturio with respect to the Service and supersede all prior or contemporaneous agreements, representations, or understandings.
21.2 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
21.3 Waiver
Triturio's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
21.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without Triturio's prior written consent. Triturio may assign these Terms freely in connection with a merger, acquisition, or sale of assets.
21.5 Notices
Notices to Triturio should be sent to support@triturio.com. Triturio may provide notices to you via the email address associated with your account or through the Service.
